해방 전후 시기 (1940~1949년)
한국 사회는 해방 되었으나 민간의 생활은 궁핍
→ 생활고와 관련된 절도 등 범죄 증가
비행소년 보호 및 교정보호의 당위성이 증대되어 대구, 안양, 광주 부산, 김해 등지에 소년원 시설 증설
→ 그러나 대부분이 시설을 탈출하여 거리로 나와 범죄소년이 날로 증가
